1.        ELIGIBILITY:

 

The “Michelob ULTRA World Cup Easter Egg Giveaway” (“Sweepstakes”) is open to legal residents of the fifty (50) United States and District of Columbia who are twenty-one (21) years of age or older at the time of entry. Employees, contractors, directors, officers and agents of Anheuser-Busch, LLC, its affiliates and subsidiaries, advertising and Sweepstakes agencies, wholesale distributors, retail licensees, and all other service agencies involved with the Sweepstakes, and members of their immediate family (spouse, parent, child or sibling), are not eligible to enter or win. The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions which are final and binding in all matters related to this Sweepstakes. Winning a prize is contingent upon fulfilling all requirements as set forth herein. 

 

2.        SWEEPSTAKES PERIOD

 

Sweepstakes begins at 12:00:00 p.m. Eastern Daylight Time (“EDT”) on November 9, 2022 and ends at 10:00:00 p.m. EDT on November 28, 2022 (“Sweepstakes Period”). Sponsor’s computer is the official time keeping device for this Sweepstakes. 

 

3.       HOW TO ENTER:

 

(1) Facebook: During the Sweepstakes Period, look for Sponsor’s Sweepstakes post inviting followers to enter for a chance to win a prize. Reply to Sponsor’s Sweepstakes post and include the hashtags #TeamULTRA and #Sweepstakes (“Entry”). You must be a registered user of Facebook and follow Michelob ULTRA on Facebook in order to enter the Sweepstakes via Facebook. Facebook registration is free and can be obtained by logging on to www.facebook.com and following the online instructions to open an account.

 

(2) Instagram: During the Sweepstakes Period, look for Sponsor’s Sweepstakes post inviting followers to enter for a chance to win a prize. Reply to Sponsor’s Sweepstakes post and include the hashtags #TeamULTRA and #Sweepstakes (also an “Entry”). You must be a registered user of Instagram and follow Michelob ULTRA on Instagram in order to enter the Sweepstakes via Instagram. Instagram registration is free and can be obtained by logging on to www.instagram.com and following the online instructions to open an account.

 

(3) Twitter: During the Sweepstakes Period, look for Sponsor’s Sweepstakes tweet inviting followers to enter for a chance to win a prize. Reply to Sponsor’s Sweepstakes tweet and include the hashtags #TeamULTRA and #Sweepstakes (also an “Entry”). You must be a registered user of Twitter and follow @MichelobULTRA on Twitter in order to enter the Sweepstakes via Twitter. Twitter registration is free and can be obtained by logging on to www.twitter.com and following the online instructions to open an account.

 

For all Entries:

If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges. 

Your settings must be set to “unprotected” and/or “public” in order for your posts to be viewable by Sponsor and its agents. Only posts that are viewable by Sponsor and its agents will be considered an Entry.

 

All Entries must be received during the Sweepstakes Period. No other forms of Entry are valid. See Appendix A for additional Entry Guidelines & Prohibited Content. Entry must comply with these Official Rules. Sponsor reserves the right, but not the obligation, to review any Entry for violation of these Official Rules and may, at its sole discretion, reject, delete, or otherwise exclude an Entry for any reason, including without limitation, if the Entry contains any Prohibited Content (as defined in Appendix A) or any other commentary or material which Sponsor, in its sole discretion deems inappropriate.         

 

4.        SWEEPSTAKES DRAWING:

 

Thirteen (13) potential winners will be selected in a random drawing to be held on or about December 1, 2022 from among all eligible Entries received by Sponsor, whose decisions are final in all matters relating to the Sweepstakes. Odds of winning depend on the number of eligible Entries received during the Sweepstakes Period

 

5.       WINNER NOTIFICATION:

 

All prizes will be awarded. Potential winners will be notified via direct message on Facebook, Instagram or Twitter and will be required to respond to the notification within forty-eight (48) hours indicating whether he/she can accept the prize. If a potential winner does not respond to the notification within the forty-eight (48) hour time period, prize will be forfeited and an alternate potential winner will be selected. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above.

 

Potential winners may be required to complete, sign and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor or Sponsor’s representative within forty-eight (48) hours of prize acceptance. Subject to verification of eligibility and compliance with the terms of these Official Rules, including verification that the winner is twenty-one (21) years of age or older, the potential winner will be declared the official winner of the Sweepstakes. If Sponsor cannot verify that the potential winner is twenty-one (21) years of age or older prior to winner notification, then the potential winner will be disqualified and an alternate potential winner will be selected. 

 

           In the event of noncompliance within any stated time period, the prize will be forfeited and an alternate potential winner will be selected. Any alternate potential winner selected will also be required to adhere to the time periods described herein. Any prize notification or prize returned to the Sponsor or its agencies as undeliverable will result in disqualification and the awarding of that prize to an alternate potential winner. 

 

           Released Parties (as defined below) are not responsible for suspended or discontinued Internet, wireless, or land-line phone service or a change in an entrant’s email, phone number or mailing address which may result in a potential winner not receiving initial prize notification or his/her prize information.

If winner cannot accept the prize as specified, prize will be forfeited and will be awarded to an alternate winner. Total ARV of all prizes is $900. Any difference between stated value and actual value will not be awarded.

 

Limit one (1) prize per person. Prizes are non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used. 

 

If Sponsor so elects, potential winner may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the potential winner will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor. If requested, the potential winner agrees to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited and will be randomly awarded to an alternate winner.

 

7.       LIMITATIONS OF LIABILITY AND RELEASE:

 

Anheuser-Busch, LLC and each of their affiliates, subsidiaries, and agencies (collectively the “Released Parties”) are not responsible for lost, late, misdirected, unintelligible, returned or undelivered Entries, email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Sweepstakes or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate Sponsor’s terms of service, as solely determined by the Sponsor, will be disqualified. You grant Sponsor an exclusive, worldwide, perpetual, irrevocable, unrestricted, royalty-free, sub-licensable and transferrable right and license to exploit your Entry (including, without limitation, your name and likeness and the names and likenesses of any and all persons in the Entry, and any intellectual property rights (e.g. copyright, trademark, etc.) contained in the Entry) in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to you or any third party, for any purpose, including, without limitation, your Entry and any person’s property (physical, personal, intellectual property rights, and indicia) contained therein. 10.     DISPUTE RESOLUTION:

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, or any claim or dispute that has arisen or may arise between you and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Missouri without giving effect to any choice of law or conflict of law rules. The place of arbitration shall be St. Louis, Missouri.

4. SWEEPSTAKES DRAWING:

Six (6) potential winners will be selected in a random drawing to be held on or about April 2, 2023 from among all eligible Entries received by Sponsor, whose decisions are final in all matters relating to the Sweepstakes. Odds of winning depend on the number of eligible Entries received during the Sweepstakes Period

5. WINNER NOTIFICATION:

All prizes will be awarded. Potential winners will be notified via direct message on Facebook, Instagram or Twitter and will be required to respond to the notification within forty-eight (48) hours indicating whether he/she can accept the prize. If a potential winner does not respond to the notification within the forty-eight (48) hour time period, prize will be forfeited and an alternate potential winner will be selected. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above.

Potential winners may be required to complete, sign and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor or Sponsor’s representative within forty-eight (48) hours of prize acceptance. Subject to verification of eligibility and compliance with the terms of these Official Rules, including verification that the winner is twenty-one (21) years of age or older, the potential winner will be declared the official winner of the Sweepstakes. If Sponsor cannot verify that the potential winner is twenty-one (21) years of age or older prior to winner notification, then the potential winner will be disqualified and an alternate potential winner will be selected.

In the event of noncompliance within any stated time period, the prize will be forfeited and an alternate potential winner will be selected. Any alternate potential winner selected will also be required to adhere to the time periods described herein. Any prize notification or prize returned to the Sponsor or its agencies as undeliverable will result in disqualification and the awarding of that prize to an alternate potential winner.

Released Parties (as defined below) are not responsible for suspended or discontinued Internet, wireless, or land-line phone service or a change in an entrant’s email, phone number or mailing address which may result in a potential winner not receiving initial prize notification or his/her prize information.

6. PRIZE DETAILS:

Prize (6 total): Winner will receive the following prize (exact prize to be determined by Sponsor, in Sponsor’s sole discretion):

Limit one (1) prize per person. Prizes are non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used.

If Sponsor so elects, potential winner may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the potential winner will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor. If requested, the potential winner agrees to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited and will be randomly awarded to an alternate winner.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, or any claim or dispute that has arisen or may arise between you and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Missouri without giving effect to any choice of law or conflict of law rules. 5.        WINNER NOTIFICATION

Potential winner(s) may also be required to complete, sign and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor within the time indicated by Sponsor in the notification to the potential winner that such document(s) is/are required.            Three (3) prizes will be awarded: Each prize consists of one (1) Tentrr Flex Pass. Approximate Retail Value (“ARV”) of each prize is $810. Use of Flex Pass is subject to the terms and conditions of such Flex Pass. 

 

           Limit of one (1) prize per person. Total ARV of all prizes is $2430. The actual value of each prize may vary. Any difference between the actual value and ARV will not be awarded. Unless otherwise provided herein, no transfer, substitution or cash equivalent for prizes is allowed, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Unless otherwise provided herein, in the event a potential winner fails to accept all elements of a prize within the time designated by Sponsor, then the potential winner will be disqualified, and the prize will be awarded to an alternate potential winner via a random drawing. If autographed prizes are awarded, any autographs are subject to the availability of the celebrity. If a pre-paid gift card is awarded, then its use is subject to the terms and conditions imposed by the card issuer. Allow 4-6 weeks for delivery of prizes. Background Check: If Sponsor so elects, potential winner may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the potential winner will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor. If requested, the potential winner agrees to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, the potential prize winner will be disqualified, and the prize will be awarded to an alternate winner.

 

Taxes. All federal, state and other tax liabilities (including income taxes and withholding taxes) arising from each prize awarded in this Sweepstakes will be the sole responsibility of each corresponding prize winner. The award of each prize with an ARV exceeding Six Hundred United States Dollars (US$600) will be reported to the Internal Revenue Service (“IRS”), as required by U.S. law using an IRS form 1099 and/or such other form(s) as are required by federal law. If applicable, Sponsor shall also report any winnings as required by applicable state law(s) using such form(s) as are required by applicable state law. Each winner subject to any such reporting requirements agrees that the ARV assigned to each prize herein and to be reported to the taxing authority is reasonable, and agrees not to dispute the amount of the ARV assigned to such prize. In the event Sponsor is required by law to withhold U.S. federal or state withholding tax from any prize awarded (and pay such amount directly to the IRS or a state taxing authority), then Sponsor shall withhold any such amount and make such payment to the IRS and/or taxing authority to the extent sufficient cash is awarded as part of such prize. In that instance, if there is not sufficient cash available as part of the awarded prize to pay the entire withholding taxes required, then the prize winner shall be required to provide Sponsor with the funds sufficient to pay the required withholding taxes before the prize winner may receive the prize. If the prize winner in that instance fails to provide Sponsor with funds sufficient to pay the required withholding taxes within the deadline established by Sponsor, then the prize winner may be disqualified, and an alternate potential prize winner will be selected via a random drawing.

 

7.        PUBLICITY AND COPYRIGHT LICENSE

 

           By entering, entrant grants Sponsor an exclusive, worldwide, perpetual, irrevocable, unrestricted, royalty-free, sub-licensable and transferrable right and license to exploit the entrant’s entry (including, without limitation, the entrant’s name, image, likeness, voice, submitted biography, and prize information, as well as the names, images, likenesses and voices of any and all persons in the entry, and any intellectual property rights (e.g. copyright, trademark, etc.) contained in the entry), without prior notice, review, or approval, in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to entrant or any third party, for any purpose, including, without limitation, the entry and any person’s property (physical, personal, intellectual property rights, and indicia) contained therein. The foregoing grant includes, without limitation, the right to reproduce, display, distribute, publicly perform, create derivative works of, alter, amend, broadcast, edit, publish, use, merchandise, license, sublicense, and adapt the entry in any and all media now or hereafter known, throughout the world, for any purpose, whether commercial in nature or otherwise, including in contexts and circumstances that result in the entry being associated with Sponsor, its affiliated companies, and/or their promotional partners. Accordingly, by entering, entrant waives any objection to such use, including without limitation, distribution, reproduction, creation of derivative works of, public performance, or display of the entry, and any claim for compensation whatsoever in connection therewith. Such waiver shall include any claim for infringement of any so-called “Moral Right,” “Droit Moral” or similar right or interest. All materials submitted become the property of Sponsor and will not be returned. 

 

8.        RELEASE

 

           By entering, each entrant agrees that Sponsor and each of its parent, subsidiary and affiliated companies, and their advertising and Sweepstakes agencies and promotional partners, and their wholesale distributors, and Tentrr, Inc., and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”), will have no liability whatsoever for, and are released and shall be held harmless by entrant against, any liability, for any injuries, losses or damages of any kind, to persons, including death, or property, or rights of publicity or privacy, defamation, copyright infringement or portrayal in a false light resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Sweepstakes or in any Sweepstakes-related activity.

1. ELIGIBILITY:

The “Michelob ULTRA Run Fund Contest” (“Contest”) is open to legal residents of the fifty (50) United States and the District of Columbia who at the time of entry identify as female or non-binary, and have not previously completed a marathon, and who are twenty-one (21) years of age or older. The Contest is void outside of such geographic area and where prohibited by law. Directors, officers, employees, agents, contractors and representatives of Sponsor, and its affiliates and subsidiaries, as well as their advertising and promotion agencies, and service agencies, and wholesale alcohol distributors and retail licensees, and New York Roadrunner, Inc., and members of their immediate family (spouse, parent, child or sibling) are not eligible to enter or win. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements as set forth herein.

2. CONTEST PERIOD:

The Contest begins at 12:01:00 a.m. Eastern Daylight Time (“ EDT”) on November 1, 2022 and ends at 11:59:59 p.m. EDT on July 1, 2023 (“Contest Period”). Sponsor’s computer is the official time keeping device for this Contest.

3. HOW TO ENTER:

During the Contest Period:

(a) Internet: Visit www.MichelobULTRA.com/RunFund (“Website”) and follow the online instructions to complete and submit an online entry. Your responses to the questions and instructions on the Website will be judged according to the Judging Criteria set forth in these Official Rules.

If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges.

There is a limit of one entry per person. Automated entries are prohibited, and any use of automated devices will result in disqualification. No person is allowed to enter with multiple email addresses nor use any other device or artifice to enter multiple times or as multiple entrants. Any person who attempts to enter with multiple email addresses, under multiple identities, or uses any device or artifice to register multiple times will be disqualified, in Sponsor’s sole discretion. Entrants are not permitted to share the same email address as another entrant.

All entries must be received and recorded during the Contest Period. Only the methods of entry described herein are valid. No other forms of entry are valid. To be valid, each entry must comply with all of these Official Rules. Any reference herein to an “entry” refers to valid entries submitted in accordance with these Official Rules by an eligible entrant.

Sponsor reserves the right, but not the obligation, to review any attempted entry for violation of these Official Rules and may, at its sole discretion, reject, delete, or otherwise exclude an attempted entry for any reason, including without limitation, if the entry contains any Prohibited Content (as defined in Appendix A) or any other commentary or material which Sponsor, in its sole discretion, deems inappropriate.

4. CONTEST JUDGING:

Upon the conclusion of the Contest Period, all eligible entries received during the Contest Period will be judged by an independent panel of judges selected by Sponsor (“Judges Panel”) using the following judging criteria (“Judging Criteria”), with each criterion weighted as follows:

(a) The inspirational value of the entry (50%);

(b) The entry’s description of the contestant’s motivation to run a marathon and/or any adversity faced by the contestant (30%); and

(c) The contestant’s running experience (20%).

The eighty (80) eligible entries receiving the highest overall scores awarded by the Judging Panel will be deemed the potential winners of the Contest and the prizes. In the event of a tie, the eligible contestant with the highest score in the first judging criterion set forth above will be declared the potential winner. In the event there is still a tie, then the tied entries will be re-judged by a new panel of judges based on the Judging Criteria and procedures stated above until the tie is broken. The decisions of the Judges Panel relating to the judging of all contestants are final and the decisions of the Sponsor are final and binding in all respects relating to this Contest. In the event any potential winner is deemed ineligible or disqualified for any reason under the provisions of these Official Rules, then an alternate winner will be selected by the Judges Panel using the Judging Criteria and tie-breaking procedures set forth herein. The odds of being declared a winner depend on the number of entries submitted and the quality of each entry.

5. WINNER NOTIFICATION:

All prizes will be awarded . Potential winner(s) will be notified via email or phone call (or if entry is allowed in these Official Rules via a social media platform, then via direct message on the social media platform the potential winner used to enter the Contest), and will be required to respond to the notification indicating whether he/she/they will accept the prize within the time indicated by the Sponsor in the notification. If a potential winner does not respond to the notification within such time period, then such potential winner may be disqualified and an alternate potential winner will be selected (time permitting) using the winner selection procedures described herein. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above.

Potential winner(s) may also be required to complete, sign and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor within the time indicated by Sponsor in the notification to the potential winner that such document(s) is/are required. Potential winners (and any travel companion where travel is awarded as a prize) may also be required to complete, sign and return a “Release of Liability, Voluntary Assumption of Risk and Indemnity Agreement” to Sponsor within the time indicated by Sponsor in the notification to the potential winner that such document(s) is/are required. Subject to verification of eligibility and compliance with the terms of these Official Rules, including verification that the potential winner is twenty-one (21) years of age or older, the potential winner will be declared an official winner of the Contest. 6. PRIZE DETAILS:

Eighty (80) prizes will be awarded: Each winner will receive one (1) entry (Bib) in the 2023 TCS New York City Marathon. Winner must be eligible for entry under any rules, terms or conditions imposed by the 2023 TCS New York City Marathon. Approximate Retail Value (“ARV”) of each prize is $295.

Limit of one (1) prize per person. Total ARV of all prizes is $23,600. The actual value of each prize may vary. Any difference between the actual value and ARV will not be awarded. Unless otherwise provided herein, no transfer, substitution or cash equivalent for prizes is allowed, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. In the event Sponsor is required by law to withhold U.S. federal or state withholding tax from any prize awarded (and pay such amount directly to the IRS or a state taxing authority), then Sponsor shall withhold any such amount and make such payment to the IRS and/or taxing authority to the extent sufficient cash is awarded as part of such prize. In that instance, if there is not sufficient cash available as part of the awarded prize to pay the entire withholding taxes required, then the prize winner shall be required to provide Sponsor with the funds sufficient to pay the required withholding taxes before the prize winner may receive the prize. If the prize winner in that instance fails to provide Sponsor with funds sufficient to pay the required withholding taxes within the deadline established by Sponsor, then the prize winner may be disqualified, and an alternate potential prize winner will be selected (time permitting) using the winner selection procedures described herein.

7. PUBLICITY AND COPYRIGHT LICENSE :

8. RELEASE :

If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. 5. WINNER NOTIFICATION:

All prizes will be awarded. Potential winners will be notified via direct message on Facebook, Instagram or Twitter and will be required to respond to the notification within forty-eight (48) hours indicating whether he/she can accept the prize. If a potential winner does not respond to the notification within the forty-eight (48) hour time period, prize will be forfeited and an alternate potential winner will be selected. 2. SWEEPSTAKES PERIOD:

Sweepstakes begins at 12:00:00 p.m. Eastern Daylight Time (“EDT”) on September 8, 2022 and ends at 5:00:00 p.m. EDT on October 31, 2022 (“Sweepstakes Period”). Sponsor’s computer is the official time keeping device for this Sweepstakes.


3. HOW TO ENTER:

Facebook: During the Sweepstakes Period, look for Sponsor’s Sweepstakes post inviting followers to enter for a chance at prize. Click on Sponsor’s Sweepstakes post and follow the instructions to submit your email, and all online entry form fields (“Entry”). You must be a registered user of Facebook and follow Michelob ULTRA on Facebook in order to enter the Sweepstakes via Facebook. Facebook registration is free and can be obtained by logging on to www.facebook.com and following the online instructions to open an account.

If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges.

Your settings must be set to “unprotected” and/or “public” in order for your posts to be viewable by Sponsor and its agents. Only posts that are viewable by Sponsor and its agents will be considered an Entry.

All Entries must be received and recorded during the Sweepstakes Period. No other forms of Entry are valid. See Appendix A for additional Entry Guidelines & Prohibited Content. Entry must comply with these Official Rules. 4. SWEEPSTAKES DRAWING:

Sixteen (16) potential winners will be selected in a random drawing to be held on or about October 31, 2022 from all eligible Entries received by Sponsor, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning depend upon the number of eligible Entries received during the Sweepstakes Period.


5. WINNER NOTIFICATION:

The prizes will be awarded. Potential winner will be notified by email and will be required to respond to the notification within forty-eight (48) hours indicating whether they can accept the prize. If a potential winner does not respond to the notification within the forty-eight (48) hour time period, prize will be forfeited and an alternate potential winner will be randomly selected. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above.

Potential winner will be required to complete, sign and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor or Sponsor’s representative within forty-eight (48) hours of prize acceptance. For all Entries :

If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges.

Your settings must be set to “unprotected” and/or “public” in order for your posts to be viewable by Sponsor and its agents. Only posts that are viewable by Sponsor and its agents will be considered an Entry.

All Entries must be received and recorded during the Sweepstakes Period. No other forms of Entry are valid. See Appendix A for additional Entry Guidelines & Prohibited Content. 4. SWEEPSTAKES DRAWING:

Potential winners will be selected in a random drawing to be held on or about September 1, 2022 from among all eligible Entries received by Sponsor, whose decisions are final in all matters relating to this Sweepstakes. Potential winners will be randomly selected from each “Group” of eligible Entries as defined below. Odds of winning depend on the number of eligible Entries received per Group.

Group 1: Sixty-nine (69) potential winners will be selected from all eligible Entries received from residents of the United States and District of Columbia (excluding Florida residents) who entered via Facebook, Instagram or Twitter.

Group 2: One (1) potential winner will be selected from all eligible Entries received from residents of Florida who entered via Facebook, Instagram or Twitter.

 

5. WINNER NOTIFICATION:

All prizes will be awarded (time permitting). Potential winners will be notified via direct message on Facebook, Instagram or Twitter and will be required to respond to the notification within forty-eight (48) hours indicating whether they can accept the prize. If a potential winner does not respond to the notification within the forty-eight (48) hour time period, prize will be forfeited and an alternate potential winner will be randomly selected (time permitting). 1. ELIGIBILITY:

The Michelob Ultra Pure Gold PTO Contest (“Contest”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least twenty-one (21) years old at the time of entry. Employees, contractors, directors, officers and agents of Anheuser-Busch, LLC, its affiliates and subsidiaries; advertising and promotion agencies, wholesale distributors, and retail licensees; Merkle Inc., and any of their parent and affiliate companies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements as set forth herein.

2. CONTEST PERIOD:

Contest begins at 12:00:00 a.m. Eastern Daylight Time (“EDT”) on September 7, 2022 and ends at 11:59:59 p.m. EDT on October 14, 2022 (“Contest Period”). Sponsor’s servers are the official time-keeping devices for the Contest.

3. HOW TO ENTER:

Visit http://www.heya.toyota.commichelobultra.com/contest-rules ( “Website”) during the Contest Period and follow the online instructions to complete and submit an online entry by responding to the following Contest prompts: (1) How would winning Paid Time Off (“PTO”) help you? and (2) Write your Out of Office message (“Entry”). Your answers to these questions will be judged according to the criteria in Rule #4.

In addition, you will be asked: (3) when you last used your allotted PTO and (4) select your ideal PTO destination from a provided list of options. Your answers to these questions will not be judged or used in any way to select winners. Select the checkbox to agree to these Official Rules and Sponsor’s Privacy Policy, then click “Submit Your PTO Entry” to enter. You will receive one (1) Contest entry.

Limit one (1) Entry per person during the Contest Period. Entries received from any person in excess of the stated limit will be void.

Automated Entries are prohibited, and any use of automated devices will cause disqualification. Entrants may not enter with multiple email addresses nor use any other device or artifice to enter multiple times or as multiple entrants. Any entrant who attempts to enter with multiple email addresses under multiple identities or uses any device or artifice to register multiple times will be disqualified and forfeits all prizes won, in Sponsor’s sole discretion. Multiple entrants are not permitted to share the same email address. Should multiple users of the same email account enter the Contest and a dispute thereafter arise regarding the identity of the entrant, the authorized account holder of said email account at the time of entry will be considered an entrant and must comply with these Official Rules. The authorized account subscriber is the natural person who is assigned the email address by the ISP or other organization responsible for assigning email addresses. Potential winners may be required to show proof of being the authorized account subscriber.

For all Entries:

Responses to each prompt are limited to two hundred seventy (270) characters or less in length and must be in English. If any response exceeds two hundred seventy (270) characters in length, only the first two hundred seventy (270) characters will be judged.

If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges.

All Entries must be received and recorded during the Contest Period. No other forms of Entry are valid. See Appendix A for additional Entry Guidelines & Prohibited Content. Entry must comply with these Official Rules. Sponsor reserves the right, but not the obligation, to review any Entry for violation of these Official Rules and may, at its sole discretion, reject, delete, or otherwise exclude an Entry for any reason, including without limitation, if the Entry contains any Prohibited Content (as defined in Appendix A) or any other commentary or material which Sponsor, in its sole discretion deems inappropriate.

4. CONTEST JUDGING:

All eligible Entries will be judged based on the following judging criteria (“Judging Criteria”) by a panel of judges (“Judges”) selected by Sponsor. The Judging Criteria includes: (1) Your response to “How would winning PTO help you?” will be judged for its memorability and enthusiasm (45% of the total score); (2) Your response to “Write your Out of Office message” will be judged for its creativity (45% of the total score); and (3) Both responses will be judged for the quality of the writing (10% of the total score). The four (4) eligible Entries receiving the highest cumulative score awarded by the Judges will be deemed the Grand Prize winners (subject to verification). The twenty (20) eligible Entries receiving the next highest cumulative scores awarded by the Judges will be deemed the Park Pass Prize winners (again, subject to verification). The one hundred (100) eligible Entries receiving next highest cumulative scores awarded by the Judges will be deemed the Merchandise Prize winners (again, subject to verification). See Rule #6 for Prize details. In the event of a tie, tied Entries will be re-judged by a new panel of Judges based on the Judging Criteria stated above until the tie is broken. The decisions of the Judges are final in all aspects of the Contest Judging. Limit one (1) prize per person.

5. WINNER NOTIFICATION:

All prizes will be awarded (time permitting). Potential winners will be notified via email on or around October 28, 2022 and must respond to the notification within the twenty-four (24) hour time period. If winner fails to respond in the designated time period, the applicable prize will be forfeited, and an alternate potential winner will be randomly selected (time permitting). Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above.

Potential Grand Prize winners will be required to complete, sign, and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor or Sponsor’s representative within twenty-four (24) hours of prize acceptance. Potential Grand Prize winners will also be required to complete, sign, and return a Release of Liability, Voluntary Assumption of Risk, and Indemnity Agreement to Sponsor or Sponsor’s representatives within twenty-four (24) hours of prize acceptance. Potential Park Pass Prize winners and Merchandise Prize winners may be required to complete, sign, and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor or Sponsor’s representative within twenty-four (24) hours of prize acceptance. Subject to verification of eligibility and compliance with the terms of these Official Rules, including verification that the winner is twenty-one (21) years of age or older, the potential winner will be declared an official winner of the Contest. If Sponsor cannot verify that the potential winner is twenty-one (21) years of age or older prior to winner notification, the potential winner will be disqualified and an alternate potential winner will be randomly selected (time permitting).

Grand Prize winner’s three (3) guests must be twenty-one (21) years of age or older as of the end date of the Contest and will be required to complete, sign, and return a liability and publicity release within twenty-four (24) hours of winner’s prize acceptance. Grand Prize winner’s guests will be required to complete, sign, and return a Release of Liability, Voluntary Assumption of Risk, and Indemnity Agreement to Sponsor or Sponsor’s representatives within twenty-four (24) hours of winner’s prize acceptance.

In the event of noncompliance within any stated time period, the prize will be forfeited, and an alternate potential winner will be randomly selected (time permitting). Any alternate potential winner selected will also be required to adhere to the time periods described herein. Any prize notification or prize returned to the Sponsor or its agencies as undeliverable will result in disqualification and the awarding of that prize to an alternate potential winner (time permitting).

Released Parties (as defined below) are not responsible for suspended or discontinued Internet, wireless, or land-line phone service or a change in an entrant’s email, phone number, or mailing address which may result in a potential winner not receiving initial prize notification or his/her prize information.

6. PRIZE DETAILS:

Grand Prize (4 total): Each Grand Prize winner will have the choice for receiving one (1) of the following trip packages (travel between March 1, 2023 and March 31, 2024) or a check for $15,000.00. If winner elects to forfeit their trip package in exchange for the cash prize, he/she must acknowledge this during completion of affidavit of eligibility and liability. This decision will be final and binding.

Option 1: The “Mountains” Grand Prize: A trip for winner and up to three (3) guests to Telluride, Colorado. Option 3: The “Beach” Grand Prize: A trip for winner and up to three (3) guests to Islamorada, Florida. Option 4: The “Hiking” Grand Prize: A trip for winner and up to three (3) guests to Gatlinburg, Tennessee. For All Trips: Trip must be booked at least twenty-one (21) days prior to the travel dates. Terms and conditions received with delivery of pre-paid card apply. If winner does not meet requirements for rental car, that portion of the prize will be forfeited in its entirety. If in Sponsor’s sole discretion, round-trip air transportation is not required due to winner’s proximity to prize location, ground transportation will be substituted for round trip air transportation at Sponsor’s sole discretion and any difference in value will not be awarded. Travel and accommodations are at the Sponsor’s discretion and subject to availability, blackout dates, and change. Winner and his/her three (3) guests must travel on the same itinerary and on the dates specified by Sponsor or prize will be forfeited and may be awarded to an alternate winner (time permitting). Winner and his/her three (3) guests must comply with all travel requirements, which may include, without limitation, presenting necessary identification (including a valid driver’s license) at the time of travel. Flight schedules are subject to change without notice. Sponsor is not liable for any missed events or opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. Winner may be required to provide a credit card at time of hotel check-in. Terms and conditions received with delivery of pre-paid card apply. Any costs incurred due to changes to the original itinerary are solely the winner’s responsibility. Ground transportation (excluding what is listed above), meals, gratuities, trip cancellation insurance, personal purchases and all other expenses not specified herein are solely the winner’s responsibility. If a winner cannot accept prize as specified, applicable prize will be forfeited and may be awarded to an alternate winner (time permitting).

Park Pass Prizes (20 total): Each winner will receive one (1) National Park Pass and Federal Recreational Lands Annual Pass, which is valid for 12 months from the date of issuance. Terms and conditions received with delivery of Annual Pass apply. ARV: $80.00.

Merchandise Prizes (100 total): Each winner will receive one (1) “Michelob Ultra Swag Bag” (exact merchandise to be determined by Sponsor, in Sponsor’s sole discretion). ARV: $80.00.

For All Prizes: If a winner cannot accept prize as specified, applicable prize will be forfeited and awarded to an alternate winner (time permitting). Total ARV of all prizes is up to $44,100.00. Any difference between stated value and actual value will not be awarded.

Prizes are non-transferable, and no cash equivalent or substitution of prize is offered, except at the sole discretion of Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used.

If Sponsor so elects, each potential winner (and his/her three (3) guests for each Grand Prize winner) may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that each potential winner (and his/her three (3) guests for each Grand Prize winner) will not bring the Sponsor into public disrepute, contempt, scandal, or ridicule or reflect unfavorably on the Sponsor. If requested, each potential winner (and his/her three (3) guests for each Grand Prize winner) agrees to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited and will be awarded to an alternate winner (time permitting).

7. LIMITATIONS OF LIABILITY AND RELEASE:

Anheuser-Busch, LLC, Administrator, and each of their affiliates, subsidiaries, and agencies (collectively the “Released Parties”) are not responsible for lost, late, misdirected, unintelligible, returned or undelivered Entries, email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Contest or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate Sponsor’s terms of service, as solely determined by the Sponsor, will be disqualified. Released Parties are not responsible for any incorrect or inaccurate information whether caused by users, tampering, hacking, or by any of the programming or equipment associated with or used in this Contest, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized Website access. Any use of robotic, macro, automatic, programmed or like entry methods will void all such Entries, and may subject that entrant to disqualification. Released Parties are not responsible for injury or damage to entrants or any other person’s computer or property related to or resulting from participating in this Contest. Should any portion of Contest be, in the Sponsor’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair administration, security, fairness or proper play of this Contest, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest, and determine the winners from valid, non-suspect Entries received prior to action taken, or otherwise as may be deemed fair and equitable by the Sponsor. In the event of a dispute regarding Entries received from multiple users having the same email account, the authorized subscriber of the email account used to enter will be deemed to be the entrant and must comply with these Official Rules. The authorized account subscriber is the natural person who is assigned the email account by the organization responsible for assigning the email account. All materials submitted become the property of Anheuser-Busch, LLC and will not be returned.

Entrants agree (a) that Sponsor and its parent, subsidiary and affiliated companies, and advertising and Contest agencies, and their respective officers, directors, employees, wholesale distributors, representatives and agents, will have no liability whatsoever for, and are released and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, to persons, including death, or property, or rights of publicity or privacy, defamation, copyright infringement or portrayal in a false light resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Contest or in any Contest-related activity, and (b) winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor (and agrees to confirm such agreement in writing) and those acting pursuant to its authority to use his/her name, submitted biography, voice and/or likeness and prize information, and/or Entry (and assign the Entry, which may be altered, changed, modified, edited, used alone or with other works, as solely determined by Sponsor) for advertising, trade and Contest purposes without further compensation, at any times or time, in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval.

8. PUBLICITY AND COPYRIGHT LICENSE:

Acceptance of prize offered constitutes permission for Sponsor to use winner’s name, voice, biographical information, and/or likeness for purposes of advertising and promotion without further compensation in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval as permitted by law.

You grant Sponsor an exclusive, worldwide, perpetual, irrevocable, unrestricted, royalty-free, sub-licensable and transferrable right and license to exploit your Entry (including, without limitation, your name and likeness and the names and likenesses of any and all persons in the Entry, and any intellectual property rights (e.g. copyright, trademark, etc.) contained in the Entry) in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to you or any third party, for any purpose, including, without limitation, your Entry and any person’s property (physical, personal, intellectual property rights, and indicia) contained therein. The foregoing grant includes, without limitation, the right to reproduce, display, distribute, publicly perform, create derivative works of, alter, amend, broadcast, edit, publish, use, merchandise, license, sublicense, and adapt the Entry in any and all media now or hereafter known, throughout the world, for any purpose, whether commercial in nature or otherwise, including in contexts and circumstances that result in your Entry being associated with a particular Sponsor or Sponsors. Accordingly, you hereby waive any objection to, such use including without limitation, distribution, reproduction, creation of derivative works of, public performance, or display of your Entry, and any claim for compensation whatsoever in connection therewith. Such waiver shall include any claim for infringement of any so-called “Moral Right,” “Droit Moral” or similar right or interest.

9. DISPUTE RESOLUTION:

You agree that any claim or dispute at law or equity that has arisen or may arise relating in any way to or arising out of the Contest or the Official Rules will be resolved in accordance with the provisions set forth in this Dispute Resolution section. PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS AND WILL HAVE A SUBSTANTIAL IMPACT ON HOW CLAIMS YOU AND WE HAVE AGAINST EACH OTHER ARE RESOLVED.

You agree that whenever you have a disagreement with Administrator or Sponsor arising out of, connected to, or in any way related to the Contest or the Official Rules, you will send a written notice to the Administrator (“Demand”). You agree that the requirements of this Dispute Resolution section will apply even to disagreements that may have arisen before you accepted these Official Rules. You must send the Demand to the following address (the “Notice Address”): Legal Department, Merkle Inc., 3000 Town Center, Suite 2100, Southfield, MI 48075. You agree that you will not take any legal action, including filing a lawsuit or demanding arbitration, until 30 days after your Demand is received. If the disagreement stated in the Demand is not resolved to your satisfaction within 30 days after it is received, and you intend on taking legal action, you agree that you will file a demand for arbitration with the American Arbitration Association (the “Arbitrator”). THIS ARBITRATION PROVISION LIMITS THE ABILITY OF YOU, ADMINISTRATOR, AND SPONSOR TO LITIGATE CLAIMS IN COURT AND YOU, ADMINISTRATOR, AND SPONSOR EACH AGREE TO WAIVE YOUR RESPECTIVE RIGHTS TO A JURY TRIAL OR A STATE OR FEDERAL JUDGE. YOU AGREE THAT YOU WILL NOT FILE ANY LAWSUIT AGAINST ADMINISTRATOR OR SPONSOR IN ANY STATE OR FEDERAL COURT. For any such filing of a demand for arbitration, you must effect proper service under the rules of the Arbitrator and notice to the Notice Address may not be sufficient. If, for any reason, the American Arbitration Association is unable to conduct the arbitration, you may file your case with any national arbitration company. The Arbitrator shall apply the AAA Consumer Arbitration Rules effective September 1, 2014 (as may be amended) and as modified by the agreement to arbitrate in this Dispute Resolution section. You agree that the Arbitrator will have sole and exclusive jurisdiction over any dispute you have with Administrator or Sponsor. The Federal Arbitration Act allows for the enforcement of arbitration agreements and governs the interpretation and enforcement of the agreement to arbitrate.

YOU AGREE THAT YOU WILL NOT FILE A CLASS ACTION OR COLLECTIVE ACTION AGAINST ADMINISTRATOR OR SPONSOR, AND THAT YOU WILL NOT PARTICIPATE IN A CLASS ACTION OR COLLECTIVE ACTION AGAINST THEM. YOU AGREE THAT YOU WILL NOT JOIN YOUR CLAIMS TO THOSE OF ANY OTHER PERSON. Notwithstanding any other provision in the Official Rules, if this class action waiver is invalidated, then the agreement to arbitrate is null and void, as though it were never entered into, and any arbitration dispute at that time will be dismissed without prejudice and may be refiled in a court. Under no circumstances do you, Administrator, or Sponsor agree to class or collective procedures in arbitration or the joinder of claims in arbitration. Administrator and Sponsor agree that we will submit all disputes with you to arbitration before the Arbitrator.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant, Administrator, and Sponsor in connection with the Contest, or any claim or dispute that has arisen or may arise between you, Administrator and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Missouri without giving effect to any choice of law or conflict of law rules. The place of arbitration shall be St. Louis, Missouri.

10. PRIVACY POLICY:

If you are verified as a prize winner, your first name, last initial, city and state will be included in a publicly available winner’s list.

  • Sponsor shall have full right and power to copy, publish, broadcast, display, distribute, use, edit, translate, alter, combine with other material, reuse, and adapt any or all portions of the Entry in any way and for any purpose whatsoever, at any time, now or in the future, in any media now known or hereafter devised throughout the World in any manner whatsoever and for any purpose.
  • Entry cannot (a) be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity; (b) promote the excessive or irresponsible consumption of alcohol, or promote illegal use of alcohol, drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous or any particular political agenda or message; (c) be obscene or offensive, endorse any form of hate or hate group; (d) contain an image of anyone under 21 years of age; (e) otherwise fail to comply with the Beer Institute Advertising and Marketing Code as made publicly available at the following online location: http://www.beerinstitute.org/assets/uploads/general-upload/2015-Beer-Ad-Code-Brochure.pdf; (f) contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind (other than Michelob Ultra), without permission, or contain any personal identification, such as license plate numbers, personal names, email addresses or street addresses; (g) contain copyrighted materials owned by others without permission; (h) contain materials embodying the names, likenesses or other indicia identifying any person, living or dead, without permission; (i) refer to or depict any names, logos or readily recognizable features of a retailer of alcohol beverages (such as a grocery store, convenience store, restaurant, bar, or any other retail location that sells alcohol beverages);or (j) depict, and cannot itself be in, violation of any law.
  • Each entrant warrants and represents that the Entry: (a) is his/her original work, (b) has not been previously published; (c) has not received previous awards; and (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity;

  • Incomplete, illegible, deceptive, or garbled Entries are not eligible.
  • Any such entrant will indemnify and hold harmless, Sponsor from any claims to the contrary.

All Entries are subject to Sponsor’s Digital Millennium Copyright Act policy, as follows: Digital Millennium Copyright Act—Anheuser-Busch is committed to respecting and protecting the legal rights of copyright owners. As such, Anheuser-Busch adheres to the following notice and take down policy, in full compliance with Section 512(c)(3) of the DMCA (17 U.S.C. § 512 et seq.). If you believe any of the Entries infringes upon your intellectual property rights, please submit a notification alleging such infringement (hereafter a “DMCA Takedown Notice”). To be valid, a DMCA Takedown Notice must (i) be provided to the Anheuser-Busch designated agent, (“Copyright Agent”), as set forth below, and (ii) include the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
  • Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled and information reasonably sufficient to permit the service provider to locate the material;
  • Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and,
  • A statement that, under penalty of perjury, the information in the notification is accurate and you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

For clarity, only DMCA Takedown Notices should go to the Copyright Agent; any other feedback, comments, online purchases, or other communications should be directed to the applicable customer service links posted on the Website. You acknowledge that in order for Anheuser-Busch to be authorized to takedown any Content, your DMCA Takedown Notice must comply with all of the requirements of this Section.

By submitting an Entry, you agree that your Entry is gratuitous and made without restriction, that it will not place Sponsor under any obligation other than as stated in these Official Rules, that Sponsor is free to publish or otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your Entry, Sponsor does do not waive any rights to use similar or related ideas previously known to Sponsor or developed by its employees, or obtained from sources other than you.

By participating, you acknowledge that your Entry may be posted on the Website or in any other form of publication, in Sponsor's sole discretion. Entries posted to the Website are not edited by Sponsor and are the views/opinions of the individual entrant and do not reflect the views of the Sponsor in any manner. By entering, you acknowledge that Sponsor has no obligation to use or post any Entry you submit.
